This Agreement does not grant any third-party rights or benefits. LocalHostingUK reserves the right to amend or modify this Agreement, as well as any incorporated policies or agreements, at its sole discretion, with such changes taking immediate effect upon posting on the Site. Continued use of the Site or Services after any such changes signifies your acceptance of the last revised Agreement. If you disagree with the latest revision, please refrain from using the Site or Services. LocalHostingUK may also notify you of changes or modifications via email, so it is crucial to maintain accurate Account information to receive notifications. LocalHostingUK bears no responsibility for undelivered notifications due to inaccurate email addresses.

2. Eligibility and Authority

Access to this Site and its Services is exclusively available to individuals capable of forming legally binding contracts under applicable laws. By using this Site or its Services, you confirm that you (i) are at least eighteen (18) years old, (ii) have the legal capacity to enter into binding contracts under applicable law, and (iii) are not barred from purchasing or receiving the Services. In such cases, references to "you," "your," "User," or "customer" will apply to the corporate entity. If, after accepting this Agreement electronically, LocalHostingUK determines that you lack the legal authority to bind the corporate entity, you will be personally responsible for fulfilling the obligations outlined in this Agreement, including payment responsibilities. LocalHostingUK will not be liable for losses or damages resulting from its reliance on any instruction, notice, document, or communication believed to be genuine and originating from an authorized representative of your corporate entity. In cases of doubt about authenticity, LocalHostingUK reserves the right (without obligation) to request additional authentication. You also agree to be bound by this Agreement for transactions conducted by you, anyone acting as your agent, or anyone using your account or the Services, whether authorized or not.

3. Accounts and Data Transfer

Accounts: To access certain features of the Site or use specific Services, you must create an Account. You confirm that all information provided during Account creation is accurate, up-to-date, and complete, and you commit to maintaining the accuracy and completeness of your Account information. If LocalHostingUK suspects your Account information is untrue, inaccurate, outdated, or incomplete, it reserves the right, at its sole discretion, to suspend or terminate your Account. You are solely responsible for all activity occurring under your Account, whether authorized or not, and you must safeguard your Account information, including your customer number/login, password, and Payment Method(s). For security reasons, LocalHostingUK recommends changing your password at least every six (6) months. Promptly notify LocalHostingUK of any security breaches or unauthorized Account use. LocalHostingUK is not liable for any losses resulting from unauthorized Account usage, but you may be liable for losses incurred by LocalHostingUK or others due to actions taken through your Account, whether by you, an authorized individual, or an unauthorized person.

Transfer of Data Abroad: If you access this Site from a country other than where our servers are located, your communication with us may involve the transfer of information, including your Account details, across international borders. By visiting this Site and communicating with us electronically, you consent to such transfers.

Account Management Access (Account Sharing): The Services allow you to grant access, based on permissions, to your LocalHostingUK account to another LocalHostingUK customer. You can revoke this access at any time. By authorizing access to your account, you acknowledge and agree to the following: (1) you have a trusted relationship with the authorized person; (2) you voluntarily grant them access to your account, allowing them to make changes; (3) depending on permissions, they may access your personal information, excluding full payment method details; and (4) you assume full legal and financial responsibility and release LocalHostingUK from related liabilities for granting such access. By requesting access to another customer's LocalHostingUK account, you agree to use the access solely for the customer's benefit and as authorized by them.

Please note that LocalHostingUK is not a party to the actual contract between a customer granting access and a customer requesting/receiving access to an account. Any disputes must be resolved directly between the parties involved.

4. Website/Services Availability

Subject to the terms and conditions of this Agreement, as well as our other policies and procedures, we will make commercially reasonable efforts to provide this Site and the Services around the clock, seven days a week. You acknowledge that this Site may occasionally be inaccessible or inoperable due to various reasons, such as equipment malfunctions, periodic maintenance, unforeseen interruptions, or events beyond our control. We do not guarantee continuous or uninterrupted access to this Site or the Service, and we disclaim any liability for any disruptions or downtime. Periodically, LocalHostingUK may offer new Services or features in a pre-release version, known as "Trial Services." Use of Trial Services is subject to specific terms and conditions, including acknowledgment that these services may be pre-release versions, pose operational risks, and are provided "AS-IS." LocalHostingUK may modify, change, or discontinue Trial Services, and they may differ substantially from the final versions. Feedback regarding Trial Services is confidential and may be used for product development and marketing purposes. Paid support services are non-refundable.

5. General Code of Conduct

You acknowledge and consent to the following:

  • Your use of this Site and its Services, including any content you submit, will conform to this Agreement and all applicable local, state, national, and international laws, rules, and regulations.
  • You will not collect or gather (nor permit others to do so) any User Content (defined below) or any non-public or personally identifiable information about another User or any individual or entity without their explicit prior written consent.
  • Your use of this Site or the Services will not, as determined by LocalHostingUK at its sole discretion:
  1. Be unlawful, promote, or encourage illegal activities.
  2. Promote, encourage, or participate in child pornography or the exploitation of minors.
  3. Promote, encourage, or engage in terrorism, violence against people, animals, or property.
  4. Promote, encourage, or engage in spam or unsolicited bulk email, or hacking or cracking computer or network systems.
  5. Promote, encourage, or engage in the sale or distribution of prescription medication without a valid prescription.
  6. Infringe upon the intellectual property rights of another User or any individual or entity.
  7. Violate the privacy or publicity rights of another User or any individual or entity or breach any confidentiality duty to another User or any individual or entity.
  8. Interfere with the operation of this Site or the Services provided herein.
  9. Contain or introduce viruses, worms, bugs, Trojan horses, cryptocurrency miners, or other harmful code, files, or programs capable of disrupting, damaging, or limiting software or hardware functionality.
  10. Contain false, deceptive language, or unsubstantiated or comparative claims regarding LocalHostingUK or its Services.
  • You will not copy or distribute any portion of this Site or the Services unless expressly authorized by LocalHostingUK.
  • You will not modify or tamper with any part of this Site, the Services, or their related technologies.
  • You will access LocalHostingUK Content (as defined below) or User Content only through this Site itself or as designated by LocalHostingUK.

However, LocalHostingUK grants the User a limited, non-exclusive, non-transferable, non-sublicensable, fully revocable license to use LocalHostingUK Content solely for generating and displaying websites created through relevant LocalHostingUK Services, as expressly permitted under these terms and conditions and solely within the relevant Services. If specific LocalHostingUK Content is provided with certain Services' plans, the User may use such LocalHostingUK Content only within the scope of those Services' plans.

    • Your User Submissions do not establish a confidential relationship or obligate LocalHostingUK to treat them as confidential or secret.
    • LocalHostingUK is under no obligation, either explicit or implicit, to develop or use your User Submissions, and no compensation is due to you or any other party for the intentional or unintentional use of your User Submissions.
    • LocalHostingUK may be working on similar content, may already be aware of such content from other sources, may intend to develop similar content independently, or may take some other action.
    • LocalHostingUK retains exclusive rights (including all intellectual property and other proprietary rights) to any User Submissions posted to this Site.     Each User of this Site is also granted a non-exclusive license to access your User Content (except for User Content designated as "private" or "password protected") through this Site and use, reproduce, distribute, prepare derivative works of, combine with other works, display, and perform your User Content as permitted through this Site's functionality and under this Agreement.     8. Content Monitoring; Account Termination Policy

    LocalHostingUK may also terminate a User's access to this Site, the Services, or their Account (solely at LocalHostingUK's discretion) without notice under the following circumstances: (i) LocalHostingUK detects or is informed of the use of this Site or the Services in ways that promote child pornography, the exploitation of children, or terrorism, or (ii) LocalHostingUK has reason to believe the User is a repeat offender. If LocalHostingUK terminates your access to this Site, Services, or the Account, LocalHostingUK may, at its sole discretion, delete any data and files stored by you on its servers. Please note that engaging in illegal activities mentioned herein using one Service does not limit LocalHostingUK's right to terminate the User's Account.

    9. Additional Reservation of Rights

    LocalHostingUK explicitly reserves the right to deny, cancel, terminate, suspend, lock, or modify access to (or control of) any Account or Services, including the right to cancel or transfer any domain name registration, for any reason (as determined by LocalHostingUK at its sole discretion). This includes but is not limited to the following scenarios:

    1. Correcting errors made by LocalHostingUK in offering or delivering any Services, including domain name registration.
    2. Safeguarding the integrity and stability of, and rectifying errors made by, any domain name registry.
    3. Assisting with fraud and abuse detection and prevention efforts.
    4. Complying with court orders against you, your domain name, or website, as well as applicable local, state, national, and international laws, rules, and regulations.
    5. Complying with law enforcement requests, including subpoena requests.
    6. Adhering to any dispute resolution process.
    7. Defending against any legal action, regardless of whether such legal action is determined to have merit.
    8. Avoiding civil or criminal liability for LocalHostingUK, its officers, directors, employees, agents, and affiliates, even in cases where you have sued or threatened to sue LocalHostingUK.

    LocalHostingUK also explicitly reserves the right to terminate, without notice to you, any and all Services if, in LocalHostingUK's sole discretion, you are harassing or threatening LocalHostingUK and/or any of its employees.

    LocalHostingUK reserves the right to access, edit, and otherwise modify your Account and Services, including User Submissions and User Content, to assist you when you reach out to Customer Service via live chat, email, or the ticketing system. LocalHostingUK shall not be liable for any loss or damage resulting from such actions.

    10. No Spam; Liquidated Damages

    No Spam: We do not tolerate the transmission of spam. We actively monitor all traffic to and from our web servers for signs of spamming. We investigate fully when customers are suspected of using our products and services for sending spam. If we determine that there is a spam problem, we will take appropriate action to resolve the issue.

    We define spam as the sending of Unsolicited Commercial Email (UCE), Unsolicited Bulk Email (UBE), or Unsolicited Facsimiles (Fax). These are emails or facsimiles sent to recipients as advertisements or otherwise, without obtaining prior confirmed consent to receive these communications. This includes, but is not limited to:

    • Email Messages
    • Newsgroup postings
    • Windows system messages
    • Pop-up messages (also known as "adware" or "spyware" messages)
    • Instant messages (using AOL, MSN, Yahoo, or other instant messenger programs)
    • Online chat room advertisements
    • Guestbook or Website Forum postings
    • Facsimile Solicitations
    • Text/SMS Messages

    We do not permit our servers and services to be used for the above-mentioned purposes. To use our products and services, you must adhere not only to all applicable laws and regulations but also to this no-spam policy. Commercial advertising and bulk emails or faxes may only be sent to recipients who have "opted-in" to receive such messages. These messages must include a legitimate return address, reply-to address, the sender's physical address, and an opt-out method in the footer of the email or fax. Upon our request, conclusive proof of opt-in may be required for an email address or fax number.

    If we determine that services are being used for spamming, we will redirect, suspend, or cancel web site hosting, domain registration, email boxes, or other relevant services until the customer addresses the issue. The registrant or customer will be required to respond via email to us, stating that they will cease sending spam or having spam sent on their behalf. In the event that we find that the abuse continues after services have been restored the first time, we may terminate the hosting and email boxes associated with the domain name in question.

    We encourage all customers and recipients of email generated from our products and services to report suspected spam. Suspected abuse can be reported to us via email at admin@localhostinguk.com.

    Liquidated Damages: You agree that we may immediately terminate any Account that we believe, in our sole and absolute discretion, is transmitting or connected with any spam or other unsolicited bulk email.

    11. Trademark and/or Copyright Claims

    LocalHostingUK fully supports the protection of intellectual property rights. If you wish to submit either (i) a trademark claim for a violation of a mark for which you hold a valid, registered trademark or service mark, or (ii) a copyright claim for material over which you hold a genuine copyright, please consult LocalHostingUK's Trademark and/or Copyright Infringement Policy, which is referenced above and available here.

    12. Links to Third-Party Websites

    This Site and the Services available on this Site may contain links to third-party websites that are neither owned nor controlled by LocalHostingUK. LocalHostingUK assumes no responsibility for the content, terms and conditions, privacy policies, or practices of any third-party websites. Furthermore, LocalHostingUK does not engage in censorship or editing of the content on any third-party websites. By using this Site or the Services available on this Site, you explicitly release LocalHostingUK from any and all liability arising from your use of any third-party website.     14. Limitation of Liability

    Under no circumstances shall LocalHostingUK, its officers, directors, employees, agents, and all third-party service providers be liable to you or any other person or entity for any direct, indirect, incidental, special, punitive, or consequential damages of any kind, including those that may arise from:

Furthermore, you acknowledge and agree that LocalHostingUK's total aggregate liability shall not exceed £10,000.00 UK Pounds.

    15. Indemnity

    You agree to defend, indemnify, and hold LocalHostingUK and its officers, directors, employees, agents, and third-party service providers harmless from and against any and all claims, demands, costs, expenses, losses, liabilities, and damages of every kind and nature (including, without limitation, reasonable attorneys' fees) imposed upon or incurred by LocalHostingUK directly or indirectly as a result of:

    2. Your violation of any provision of this Agreement or the policies or agreements incorporated herein.
    3. Your violation of any third-party right, including, but not limited to, any intellectual property or other proprietary right.

    The indemnification obligations under this section will remain in effect even after the termination or expiration of this Agreement or your use of this Site or the Services on this Site.

    16. Discontinued Services; End of Life Policy

    LocalHostingUK reserves the right to discontinue offering or providing any of its Services at any time, for any reason or without any reason, and without prior notice. Although LocalHostingUK endeavors to extend the lifespan of all its Services, there are instances when a Service we offer will be discontinued or reach its End-of-Life ("EOL"). In such cases, the product or service will no longer be supported by LocalHostingUK in any manner, effective as of the EOL date.

    Notice and Migration: In the event that any Service we offer has reached or will reach EOL, we will attempt to notify you at least thirty days in advance of the EOL date. You are responsible for taking all necessary actions to replace the Service by migrating to a new Service before the EOL date or by discontinuing reliance on said Service before the EOL date. In either case, LocalHostingUK may offer either a comparable Service for you to migrate to for the remainder of your purchase term, a prorated in-store credit, or a prorated refund, at LocalHostingUK's sole and absolute discretion. If available, LocalHostingUK may migrate you to the most up-to-date version of the Service with or without notice. You agree to assume full responsibility for any loss or damage resulting from such migration.

    No Liability: LocalHostingUK will not be liable to you or any third party for any modification, suspension, or discontinuance of any Services we may offer or provide access to.

    17. Fees and Payment

    You acknowledge that your chosen Payment Method may be charged by one of our affiliated entities. Depending on the location of your payment, it will be processed by either LocalHostingUK, registered at 10 St. Michaels Villas Leeds LS6 3AF WY, UK, or by an affiliated entity within the specified country that collaborates with our local payment service provider, in accordance with our Privacy Policy.

    (A) General Terms, Including Automatic Renewal Terms

    Upon purchasing our Services, you agree to provide accurate and complete payment-related information, including details required for tax exemptions such as VAT/GST numbers. Claims or requests related to payments will only be considered if submitted within 30 days from the date of purchase, unless applicable laws stipulate otherwise.

    If you opt for automatic payments, you must maintain one designated primary payment method. You may also add a backup payment method to your account to ensure continuous service access in case the primary method encounters issues. If the primary method fails, we will automatically charge your backup payment method to prevent service disruptions.

    You agree to pay all prices and fees for Services at the time of purchase, and these fees are non-refundable unless otherwise stated in our Refund Policy section below, even if your Services are suspended, terminated, or transferred before the end of the term. LocalHostingUK reserves the right to change or adjust prices and fees at any time, with such changes being posted on this Site and taking immediate effect without further notice. If you have purchased Services for several months or years, price changes will apply upon renewal, as described below. You can pay for Services through various Payment Methods, including valid credit cards, Stripe, or in-store credit balances if applicable.

    For Services offering "Express Checkout," clicking the button will place an order and charge the primary Payment Method on file for your Account. Confirmation will be sent to your email address. Your Payment Method must remain valid if you have active Services. Any refunds issued will be considered fulfilled when LocalHostingUK submits the refund to the Payment Method used for the initial purchase. Refund posting time frames depend on the payment provider and bank and may vary.

    To ensure uninterrupted Services, most offerings include automatic renewal options. Unless you disable this option, LocalHostingUK will automatically renew the Service at the end of each term using the Payment Method on file, at the current rates which may differ from previous terms. You can enable or disable automatic renewal at any time, but failure to manually renew before expiration may lead to service interruptions, for which LocalHostingUK is not liable.

    LocalHostingUK may participate in "recurring billing programs" or "account updater services" supported by your credit card provider. If your automatic renewal attempt fails, your bank may update your credit card information or charge a new card without notification to LocalHostingUK. You are responsible for maintaining your Account settings and Payment Methods to avoid service interruptions.

    If LocalHostingUK is unable to charge your Payment Method for the full amount owed or faces chargebacks or payment disputes, LocalHostingUK may pursue remedies, including immediate cancellation of registered domain names or Services. LocalHostingUK may also charge reasonable "administrative fees" or "processing fees" for various scenarios, such as non-standard customer service requests, additional time or costs incurred due to non-compliance with this Agreement, or chargebacks.

    Administrative or processing fees will be billed to your Payment Method. LocalHostingUK may offer product pricing in multiple currencies, but transactions are primarily processed in UK Pounds or a few Supported Currencies. If the selected currency differs from your bank's currency, you may incur exchange rate conversion fees by your bank. LocalHostingUK is not responsible for exchange rate fluctuations or discrepancies between the amount processed and what appears on your bank statement.

    Additionally, you may be subject to Value Added Tax (VAT), Goods and Services Tax (GST), or other localized fees and taxes based on your bank or billing address.

    Refund Policy:

    Eligible products and services can be fully refunded within thirty (30) days of purchase, except when a product includes a free domain name. In such cases, the domain name's list price will be deducted from the refund amount.

    You are not eligible for more than one refund for the same product.

    (B) Stripe

    By using LocalHostingUK's Stripe payment option, you authorize Stripe to charge the full purchase amount from your Stripe Account or linked payment methods. Ensure your Stripe Account and associated funding sources are current and sufficiently funded. Stripe may decline transactions for various reasons, and neither Stripe nor LocalHostingUK is liable in such cases. Failure to fund your Stripe Account may result in a service charge of £25.00 or the maximum allowed by law.

    (C) International Payment Options

    LocalHostingUK offers alternative international payment options through International Payment Providers (IPP). When selecting an IPP, you must have already agreed to their customer service agreements. You authorize the IPP to debit your selected Funding Sources for the full purchase amount. You are responsible for keeping your Funding Sources current and funded. The IPP may decline transactions, and neither the IPP nor LocalHostingUK is liable in such cases.

    LocalHostingUK will not fulfill your Services until confirmation of payment is received from the IPP, which may take hours or days. Failure to confirm payment within thirty (30) days may result in order cancellation. In-store credit may be used to cover incomplete transactions or administrative fees.

    (D) In-Store Credit Balances

    If your Account contains in-store credit, you can apply it to future purchases or use it to cover outstanding administrative fees or chargebacks. If your default Payment Method fails, LocalHostingUK may use available in-store credit for automated billing. Regardless of the in-store credit amount, LocalHostingUK is not responsible for product loss due to payment collection issues. In-store credits are non-transferrable and may expire, with complimentary credits expiring two years after issuance. Upon Account termination, any remaining in-store credit is forfeited.

    Funds held as in-store credit do not accrue interest, and any interest accrued is retained by LocalHostingUK to cover associated costs.

    (E) Cryptocurrencies, Tokens, and Digital Assets

    LocalHostingUK accepts various cryptocurrencies, tokens, and digital assets through Cryptocurrency Payment Providers (CPP). By selecting a CPP, you agree to their customer service agreements. CPPs may charge Exchange Rate Conversion Fees, Transaction Fees, and other applicable fees. CPP Fees are subject to change without notice.

    CPPs may decline transactions, and neither the CPP nor LocalHostingUK is liable in such cases. LocalHostingUK will not fulfill your Services until confirmation of payment is received from the CPP. There may be a delay between placing an order and confirmation.

    If the CPP confirms a payment that exceeds the service cost, LocalHostingUK may issue a partial refund. CPPs may impose limitations on refunds, and LocalHostingUK reserves the right to issue refunds as in-store credit.

    You are responsible for staying informed of CPP Fee changes and maintaining your CPP Funding Sources.

    18. Successors and Transferees

    This Agreement remains binding upon and beneficial to the involved parties, as well as their respective heirs, successors, and assigns.

    19. No Third-Party Beneficiaries

    This Agreement does not grant any rights or benefits to third parties.

    20. Compliance with Local Laws

    LocalHostingUK does not assure that the content available on this Site or the Services offered at this Site is suitable for every country or jurisdiction. Access to this Site or its Services from regions where its content is illegal is prohibited. Users accessing this Site or its Services are responsible for complying with all local laws, rules, and regulations.

    21. Governing Law; Jurisdiction; Venue; Jury Trial Waiver

    With the exception of disputes governed by the Uniform Domain Name Dispute Resolution Policy mentioned above, this Agreement is subject to the laws of the United Kingdom. You agree to waive the right to a trial by jury in any legal action or proceeding related to or arising from this Agreement.

    22. Titles and Headings; Independent Covenants; Severability

    The titles and headings within this Agreement are provided for convenience and reference only, and they should not be used to interpret or construe the parties' agreement differently from what is stated herein. Each covenant and agreement within this Agreement is considered a distinct and independent commitment. If a court with proper jurisdiction deems any provision (or part of a provision) of this Agreement to be unlawful, invalid, or unenforceable, the remaining provisions (or parts of provisions) will remain unaffected and remain valid and enforceable to the fullest extent permitted by law.
